The project is in part the result of the 9th US Circuit Court of Appeals decision in May 2022 that upheld U.S. District Judge Soto's decision from July 2019. Judge Soto's 2019 decision vacated the US Forest Service's Rosemont Record Of Decision and shut the Rosemont project down.
